Summary
The complete text of the Bakke decision and the Equal Employment Opportunity Commission's voluntary affirmative action guidelines are presented. Also included are: Statement by the U.S. Commission on Civil Rights on Affirmative Action; Presidential Memorandum on Affirmative Action Programs; and the United States Commission on Civil Rights Statement on Affirmative Action. These documents outline national policy with respect to affirmative action in education and employment. An introductory statement explains the diverse opinions of the Supreme Court that permit institutions of higher education to use race and national origin affirmatively in certain settings and in certain ways. Despite confusion, it is suggested that the decision is consistent with continuing federal efforts to encourage affirmative measures to overcome race, national origin, and sex discrimination. The first definitive statement by the executive branch on voluntary affirmative action in employment elaborates on these federal efforts. The guidelines of the Equal Employment Opportunity Commission offer a unified and comprehensive perspective on the lawfulness of voluntary affirmative action.
