- Summary
- This is a unique collection of papers written by five of the United Kingdom's most distinguished judges (in alphabetical order, Sir Robin Auld, Sir Thomas Bingham, Master of the Rolls, Lord Browne-Wilkinson, Judge Edward of the Court of the European Communities, and Lord Goff), and eleven professors of international repute representing some of the major legal systems of Europe (von Bar and Lorenz - Germany; Delmas Marty and Tallon - France; Bonell and Francioni - Italy; Schermers - The Netherlands; Bocken - Belgium; Markesinis, Spencer, and Wyatt - England) and a leading practitioner in the field of environmental law (Tromans). Using mostly comparative methods they discuss topical issues from the areas of contract and torts, crime and criminal procedure, international conventions, human rights, and environmental law, and suggest that the move towards European unity, despite its ups and downs, is proceeding apace, even though unity does not (and need not) imply uniformity. Noticeable too is the marked convergence of solutions and techniques, prompted by the similarity of the problems which confront members states, and the growing influence, direct and indirect, of the two European Courts upon their national law. This book, both in its descriptive and prescriptive aspects, will provide much food for thought for both students and practitioners interested in foreign law, comparative law and methodology, law reform, and European law in general.
